Rights clearance in Peru runs through Decreto Legislativo 822, the Peruvian Copyright Law, which INDECOPI administers. Music rights clear through APDAYC (Asociación Peruana de Autores y Compositores). The Unión Peruana de Productores Fonográficos covers master and mechanical use.

The legal landscape reaches well beyond music. Trademarks are registered with INDECOPI. The moral rights of Peruvian authors cannot be waived, even by contract, under Decreto Legislativo 822. Heritage sites need location releases, since INC holds the image rights there. Quechua and Aymara cultural expression is a trickier area. Here the consent of the whole community counts as much as any individual signature. Our licensing team works from Lima with trusted legal partners across the IP bar. Regional fixers in Cusco and Arequipa handle the harder community-rights questions on Sacred Valley and Lake Titicaca shoots. They settle these before they become post-production blockers.

Our process opens with a rights audit against your script, score, and shot breakdown. We flag each music cue, archive clip, trademark, and image that needs clearance. Each one is then mapped to the right Peruvian collecting society, rights holder, or community body. APDAYC sync and performance licenses are negotiated in soles or USD, depending on the deal. Mechanical and master rights go through the right fonograma producers. For archive material from RTV Perú, IRTP, or Filmoteca PUCP, we arrange access and licensing through the official channels that hold the masters.

Talent likeness and image releases follow ANACTP guidelines for actors. For Indigenous communities, where consent to photograph and record is collective, we use custom contracts. The result is a clean chain of title. It satisfies global distributors, OTT platforms, and broadcast buyers. The same chain stays compliant with Peruvian copyright law and the Ibermedia co-production framework where it applies.
